CONDITIONS OF SALE

  • Wood characteristics such as shapes, sizes, grains, colors, markings, pin knots, and pitch pockets may vary from one unit to another. No two units are the same.
    1. Color stain on actual merchandise may vary slightly from the color on the swatch stick depending on the natural color shade of the wood.
    2. Our technique is to preserve the natural grain pattern of the wood. Therefore, natural characteristics of the wood such as color, grain, markings, pin knots, and pitch pockets may cause unevenness or variability in the color stain.
  • Fabrics used in upholstery may slightly vary in terms of color and texture depending on what batch it came from.
  • Merchandise may vary up to 1 inch.

DELIVERY CONDITIONS

  1. The buyer will be advised as soon as possible when the goods are available for delivery.
  2. The buyer is required to schedule the delivery date within 15 days of the transaction date or before the last day of storage. Failure to do so will result in additional Storage Fee charges or result in cancellation of the sale.
  3. The buyer must ensure that accessible parking, delivery access (e.g., gate pass), and ensure a competent representative is present for goods delivery and assembly on the scheduled date.
  4. The buyer is responsible for covering delivery team charges (e.g., parking fees, gate pass). If restricted access poses delivery hazards, we may refuse unless you agree in writing to assume the risk. In such cases, while we exercise reasonable care, we're not liable for any loss or damages during delivery attempts.
  5. Our delivery team carries items up to the 3rd floor only. Notify us if there is no service elevator. No lift access fee shall be applied for addresses without it or where items won't fit in it: a ₱350 fee applies to floors 4-6, ₱750 for 7-10. This is payable with the delivery fee. We may refuse delivery if address is above the 10th floor and building is without a service elevator.
  6. In the event that we're unable to deliver and assemble the goods on the notified date due to the buyer's failure to comply with delivery agreements, we'll mutually agree upon an alternative delivery/assembly date at the earliest convenience. Please note, re-delivery, assembly, and any applicable storage fees must be settled before the rescheduled delivery.
  7. Delivery of goods will only be to the address indicated on the customer order form. We are unable to deliver goods, inspect premises or arrange collections on Sundays or Bank holidays.
  8. The buyer will become responsible for the risk of loss or damage to the goods you ordered once the items are delivered and received.
  9. DELIVERY CANCELLATION – the buyer must inform 3 days before the final date of delivery of any changes in the delivery schedule. Any changes occurring after the deadline will result in a redelivery fee of the same amount initially charged to the client.
  10. REFUSAL to sign any delivery document by the buyer/representative will be taken as a refusal to accept delivery.
  11. Refusal to accept delivery by the buyer may lead to the forfeiture of the delivery, where the buyer loses the right to receive the items, and Ashley Furniture Philippines, Bedscape Corp., is no longer responsible for completing the delivery. Consequences of refusal may include non-redelivery, additional charges (such as pull-out and redelivery fees, and storage fees), and potential forfeiture of the entire transaction.

RETURNS AND EXCHANGES POLICY

  1. SALE IS FINAL and Ashley Furniture HomeStore reserves the right to refuse returns and exchanges, and refunds for items with conditions that are deemed unacceptable and unsalable.
    1. As stated in RA7394 or Consumer Act of the Philippines, the ff. conditions are not entitled to any return and exchange, or refund:

      i. If the product purchased has no imperfection or defect, or if not expired or fake.

      ii. When the defects of the goods are due to the mishandling of the Client

      iii. In cases of “as-is-where-is” transactions

      iv. If the consumer had a “change of mind

    2. Only items with factory defects, flaws or not sold as advertised may be subject to refund or return and exchange without charges.
    3. For cases where a return and exchange or refund of an item without any defects or flaws is approved, a restocking fee will be charged:

    i. 10% restocking fee for Return and Exchange.

    ii. 20% restocking fee for Refund

  2. Exchange of merchandise shall be allowed within 7 days after delivery and will be subject to the following conditions:
  3. After 7 days from the delivery date, we will no longer honor requests for outright replacement or refund.
  4. The exchange value should be the net amount paid by the customer for the item being returned. Any other fees will be charged and included in the new transaction (e.g., delivery fee, gate pass, parking, etc.)
  5. Selected item/s for exchange may be of the same, lower, or higher value as the item/s being returned. The price difference must be paid. Balance can be converted as Store Credit but must be used within 30 days or will be forfeited.
 

WARRANTY:

  1. All goods supplied by us are warranted to be of satisfactory quality, fit for their normal purpose, and free from defects for 60 days (unless specified) from the date of delivery unless otherwise specified.
    The 60-day warranty for items under storage will start after 1-month of storage.
  2. This warranty does not apply to any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by the Client or any third party, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried out without our approval.
  3. Other terms and conditions apply.

NOTICES:

Any notice required or permitted to be given by either of us to the other under these Conditions shall be in writing addressed to the other party at his address as set out on the customer order form.

APPLICABLE LAW:

These Conditions and the supply of the goods will be subject to Philippine law, and the Philippine courts will have jurisdiction in respect of any dispute arising under the contract.
